A 69-year-old German man who reportedly had sex with his daughter more than 500 times and fathered three kids with her has been cleared of rape.
Adolf Bergbauer was sentenced to just two years and eight months behind bars for incest after a German judge threw out the rape charges on a count of inconsistencies in the woman’s story.
Mr Bergbauer claims that it was his daughter who ‘propositioned him’ for sex since the age of 12, reports the Huffington Post. The Huff Post also reports that Bergbauer cannot be charged with statutory rape because the incidents happened more than 20 years ago.
Bergbauer’s daughter, now aged 46, denies her father’s claims and told a Nuremberg court that he regularly beat her and said he’d kill her if she told anyone. The woman gave birth to three sons all conceived with her father, two of whom have died since.
The case only came to light after the woman was convicted of blackmailing the wife of a doctor she blamed for the disability of one of her sons, reports the Daily Mail.
Lawyers fighting for the woman’s case demanded a 14-year sentence for her father however the court ruled that it was impossible to prove the relationship was not consensual and pointed out inconsistencies in her testimony.
